A Pensacola man is celebrating a court victory, this week.

Two men, accused of doing shoddy work on his business after Hurricane Ivan, must now pay him restitution, but what he really wants is to protect other potential victims.

"Offshore International" in Pensacola was hit hard by Hurricane Ivan.

The storm destroyed the roof and ripped through the building.

Owner, Thomas Brewer, was desperate to get it fixed, but he couldn't find a contractor who was free to do the work....until he came across Ceasar Sanchez and David Tywater, of Brevian Builders, in early 2005.

Thomas Brewer/Pensacola Businessman: "I was very thorough. I went on the internet, I made phone calls and I checked out what they had presented to me as who they were and they checked out perfect."

But the work they did on Brewer's roof was not.

Brewer: "Three days after the roof was finished and the check was cut, the roof was leaking."

Brewer was out nearly twenty thousand dollars.

It turned out the men were working under another contractor's License and all the paperwork they showed him, wasn't their's.

Even the building permit they had was fake.

Brewer called the builders for months and was finally told by one of their salesman....

Brewer: "Mr. Brewer you have been screwed. These people have done this before. They've hurt a lot of other people. They're going to do this again in the future and you've just been screwed and there's nothing I can do to help you. They've already left town."

Brewer tracked them down on the internet and spent the next three years keeping tabs on Sanchez and Tywater.

He worked with local, state, and federal authorities, but in the end it's what he found on his own that sent them to court.

Brewer says Sanchez and Tywater move from state to state, chasing natural disasters and setting up shop under different company names.

Brewer: "What I ended up finding out was that these individuals have got their own computer guy in Lake Jackson, Texas. What he does is he goes in and he sets up these nice, shiny web pages, very professional looking, to basically substantiate their legitimacy."

Brewer says once the complaints start, the websites disappear.

This is a website for a business in Mississippi established by the same computer guy.

Brewer called one of the contact numbers and got this....
"The number you have reached has been disconnected...."

Tuesday, Sanchez and Tywater pleaded no contest to contracting without a license during a state of emergency in Brewer's case.

They were sentenced to five years probation and court ordered to pay restitution.

Brewer says it's not about money, it's about justice.

Brewer: "Hopefully this might slow them down or it might save just even one other person out there from being victimized, once again."

The Pensacola attorney representing Sanchez and Tywater says had "no intent to deceive anybody" and were led to believe they could work under another contractor.

There are now several complaints lodged against Sanchez and Tywater with the Florida Department of Business and Professional Regulation.

Since Hurricane Ivan, the State Attorney's Office has investigated 360 cases involving contracting without a license in the Panhandle area.

Jackson, MS--Two out-of-state contractors have been arrested for felony home repair fraud against Katrina victims on Mississippi’s Gulf Coast, announced Attorney General Jim Hood today.

Carlos Enrique Sanchez (Ceasar, Cesar Sanchez's brother), age 42, of Pearland, Texas (dba Mineo Homes) was arrested Wednesday, October 14, on three indictments for felony home repair fraud. Sanchez and his now former business partner, Samuel Mineo were indicted for failing to do work they were paid to do on three homes ( two in Gulfport, one in Pass Christian) that were lost due to Hurricane Katrina. Mineo turned himself in to the Attorney General’s Office in October 2008. Sanchez did not turn himself in after agreeing to do so and has since been considered “on the run”. The Mississippi Attorney General’s Office requested the assistance of the Texas Attorney General’s Office after learning Sanchez was in Texas. He was arrested in Austin, TX on September 16, 2009 by the Texas Attorney General’s Office and returned to Mississippi on Wednesday by the Harrison County Sheriff’s Office. Sanchez was booked into the Harrison County Adult Detention Center. He faces up to 10 years and/or a $10,000 fine, plus restitution to the victims. The case was investigated by the Consumer Protection Division of the Attorney General’s Office and will be prosecuted in conjunction with District Attorney Cono Caranna’s Office.

“We would like to thank Texas Attorney General Greg Abbott, Travis County Texas Sheriff Greg Hamilton and both of their offices for all of their work in this case,” said Attorney General Hood. “Their teamwork combined with the efforts of Harrison County Sheriff Melvin Brisolara, District Attorney Cono Caranna and their offices will make sure this case reaches a just resolution.”

I'm in the Austin area; I'd be interested to know if this guy was doing roof work in our area.

After all the work started to dry up from Hurricane Ike, we got flooded with storm chasers who have now set up shop here.

I am serious; I can't go 5 minutes on the freeway without seeing another roofing truck & I used to be able to go a long run without seeing any competition.

Not sure if this would fall under a "Scam" but it is at minimum very very shady.

My bosses dad shows up at our yard one morning with a folder about an inch thick and throws it on my desk. I asked him what it was, it was a roof proposal from a new company to our area in San Jose, CA. This was for a friend of theirs that live in their neighborhood. The process went something like this.
Girl knocks on door, (Paraphrasing) We're in your area offering our services and noticed your roof appears to be on its last legs. Girl measures roof from ground by walking perimeter of house. Says they'll drop by a folder with an estimate in a day or two. A day or two later same girl and sales guy come back. Meet with people and present estimate. I don't recall the squares off top of my head but I'd say 25-27. They put the estimate on the table at a starting point of $21k+ of course since you're a senior citizen we're going to trim $1500 right off the top AND since we're running a promo right now where everyone gets $1500 off a re-roof job, you've saved $3K already. LUCKILY they said they'd have to think about it. We've done quite a few roofs in this neighborhood so I know the area pretty well as the houses are all very similar in size. I went and measured the roof for them and we could put on the same roof that was being offered to them (30 year dimensional) for less than $12K! Was more than $6K difference. I was floored that they were running around taking advantage of people like that.

Thats not a scam because they can get a better price than you do ,if you could get the same price as them then would you be the one scaming?. This is not a scam if they have all the ins,workmans comp,liecenses needed and have a signed contract, its called free enterprise

When you're taking advantage of someone who doesn't know any better, and clearly piling on, it may not be a scam but it sure wreaks of a poor way to treat people, especially elderly people.

We wouldn't TRY and get that price, it's excessive. If we as licensed, bonded roofers, in business for more than 20 years can do a job for less than 12K, there is no reason to start a job at more than 21k so you can give someone an imaginary 3k in discounts and sell the job for 6k more than it can be done for by a legit roofer. Free enterprise? I suppose, I guess it depends on if you want to sleep well at night or not. Very Happy

Is all there jobs for the elderly? it may be elder abuse? if investigated.Have you or your boss charge the same price for all your jobs.I live in ca also , for some one in Palo Alto is goin to pay more than a home with same sq feet in sunnyvale ,right. Is that a scam?

I just want to say I have been a roofer for over 40 years and I have seen lots of stuff. I must say this is the most negative thread for a roofing website I have ever read.
How about INPUT NEEDED: examples of Homeowner scams.

I have seen many of those also,anyone in this business for any length of time has.
Yes some roofers are scum and yes some homeowners are scum lets give a sticky thread dedicated to the scum homeowners.

The most common homeowner scam I seem to come across is aided & abetted by roofers:

Reduced or 100% NO deductible.

The rest, outside of not paying a final amount due, is all negotiation.
